April 2022<\/p>\n<h3><\/h3>\n<h3 style=\"text-align: center;\">Bundesblock pr\u00fcft Nichtigkeitsklage gegen versch\u00e4rfte EU-Regulierung f\u00fcr Crypto-Assets<\/h3>\n<p>&nbsp;<\/p>\n<p><strong>Angesichts der ab dem 28. April 2022 anstehenden Trilog-Beratungen im Europaparlament positioniert sich der Bundesverband Blockchain klar gegen die zuletzt im Europaparlament vorgeschlagenen Regeln.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>Demnach sollen mit der Transfer of Funds Regulation (TFOFR) sehr strenge Identifikations- und Dokumentationserfordernisse einf\u00fchrt werden. Konkret sieht der vorgelegte Entwurf vor, dass k\u00fcnftig alle in Europa ans\u00e4ssigen Anbieter von Dienstleistungen f\u00fcr Krypto-Assets (Crypto Asset Service Providers &#8211; CASPs) verpflichtet sind, f\u00fcr jede Transaktion die Identit\u00e4t des Absenders und Empf\u00e4ngers zu erfassen, zu \u00fcberpr\u00fcfen und zu speichern. Anders als in den vergleichbaren Regelungen f\u00fcr Bargeldtransaktionen oder etwa den Kauf von Edelmetallen soll es bei Krypto-Assets keinen Mindestbetrag f\u00fcr diese Datenerfassung geben.<br \/>\nSollte die TFOFR in der aktuellen Fassung im Trilog verabschiedet werden, wird der Bundesblock eine Nichtigkeitsklage pr\u00fcfen.<\/p>\n<p>Aus Sicht des Bundesblocks werden die geplanten Vorschriften dazu f\u00fchren, dass viele Startups im Bereich der Krypto-W\u00e4hrungen einen Standort ausserhalb der EU bevorzugen werden, da dort weniger strenge Regeln gelten. Neben den zus\u00e4tzlichen Kosten und Risiken, die mit der neuen Regulierung auf europ\u00e4ische Anbieter zukommen w\u00fcrden, sorgt sich der Bundesblock mit seinen mehr als 100 Mitgliedern aber vor allem auch um den Datenschutz. Die neuen Vorschriften w\u00fcrden dazu f\u00fchren, dass k\u00fcnftig jede noch so kleine Transaktion in Kryptowerten in einer Datenbank der beteiligten Dienstleister erfasst und mit den pers\u00f6nlichen Daten der Beteiligten gespeichert wird. Mit dieser Datenerfassung w\u00fcrde das Europaparlament das in der Datenschutzgrundverordnung festgelegte Prinzip der Datenminimierung selbst ad absurdum f\u00fchren.<\/p>\n<p>Dr. Aschkan Allahgholi, Pr\u00e4sident des Bundesblocks, erl\u00e4utert dazu: \u201cWenn die neue EU-Regulierung dazu f\u00fchrt, dass selbst f\u00fcr Cent-Betr\u00e4ge, die in Kryptowerten bezahlt werden, ein Datensatz mit den pers\u00f6nlichen Details des Senders und Empf\u00e4ngers generiert werden muss, verletzt das Europ\u00e4ische Parlament seine selbst gesetzten Prinzipien\u201d. Auch Philipp Hartmannsgruber, ebenfalls Vorstand beim Bundesblocks positioniert sich deutlich: \u201cDiese Regeln treten das Grundrecht auf informationelle Selbstbestimmung mit F\u00fc\u00dfen. Ohne jede Notwendigkeit oder Berechtigung werden redundante Datenbest\u00e4nde generiert, f\u00fcr die keinerlei Berechtigung oder Zweckbestimmung besteht.\u201d<\/p>\n<p>Neben der datenschutzrechtlichen Sorgen ist die geplante Regulierung auch technologisch ein R\u00fcckschritt in die Steinzeit der Digitalisierung. Moritz Schildt, weiteres Vorstandsmitglied des Bundesblocks erkl\u00e4rt: \u201cDie Blockchain-Technologie nutzt dezentrale Speicherung und kryptografische Verschl\u00fcsselung um Datensicherheit und Datenschutz sicher zu stellen. Die geplanten EU-Regeln stehen im Widerspruch zu dieser Idee. In concrete terms, the proposed draft stipulates that in future all providers of services for crypto assets (Crypto Asset Service Providers &#8211; CASPs) based in Europe will be obliged to record, check and save the identity of the sender and recipient for every transaction. Unlike the comparable regulations for cash transactions or the purchase of precious metals, there should be no minimum amount for this data collection for crypto assets.<br \/>\nIf the TFOFR is passed in the current version in the trilogue, the federal bloc will consider an action for annulment.<\/p>\n<p>Although numerous companies and associations have expressed criticism and requests for changes in extensive statements, the European Parliament apparently wants to introduce very strict identification and documentation requirements with the Transfer of Funds Regulation (TFOFR). Unlike the comparable regulations for cash transactions or the purchase of precious metals, there should be no minimum amount for this data collection for crypto assets.<\/p>\n<p>From the perspective of the German Blockchain Association, the planned regulations will mean that many startups in the cryptocurrency sector will prefer a location outside the EU, as less strict rules apply there. In addition to the additional costs and risks that the new regulation would bring to European providers, the federal bloc with its more than 100 members is primarily concerned about data protection. The new regulations would mean that in future every crypto transaction, no matter how small, would be recorded in a database of the service providers involved and saved with the personal data of those involved. With this data collection, the European Parliament would itself take the principle of data minimization laid down in the General Data Protection Regulation ad absurdum.<\/p>\n<p>Dr Aschkan Allahgholi, President of the German Blockchain Association, explains: \u201cIf the new EU regulation means that even for cent amounts that are paid in crypto assets, a data set with the personal details of the sender and recipient has to be generated, the European Parliament violates its self-imposed principles\u201d. Philipp Hartmannsgruber, als board member at the Bundesblock, also takes clear position: \u201cThese rules trample on the fundamental right of informational self-determination. Redundant databases are generated without any need or justification for which there is no justification or purpose.\u201d<\/p>\n<p>In addition to the data protection concerns, the planned regulation is also a technological step backwards into the stone age of digitization. Moritz Schildt, also a board member of the Bundesblock, explains: \u201cThe blockchain technology uses decentralized storage and cryptographic encryption to ensure data security and data protection. The planned EU rules are at odds with this idea.
